e-banking User Agreement

for i-connect online banking and mobile banking

 
Please read the following e-banking User Agreement for i-connect internet banking and mobile banking. This User Agreement includes disclaimers of liability and other items of interest to you. TERMS OF AGREEMENT

This User Agreement between you and The National Bank & Trust Company explains the terms and conditions governing i-connect internet banking and Mobile Banking. By using NB&T's e-banking , you agree to the terms and conditions of this User Agreement. This User Agreement will be governed by and interpreted in accordance with Federal law and regulation, and to the extent there is no applicable Federal law or regulation, by the laws of the State of Illinois.

In addition to this User Agreement, all Consumer Deposit Account Agreements and Disclosures, as well as our Privacy Policy will also apply to your Consumer Account(s). We suggest that you review each of these documents in order to understand all of your rights and responsibilities in relation to the use of
NB&T's e-banking .

i-connect internet banking and Mobile Banking can be used to access your Consumer Account(s) at The National Bank & Trust Company. Each of your Consumer Account(s) at The National Bank & Trust Company is also governed by the applicable consumer account agreement and disclosure statement ("Consumer Deposit Account Agreement and Disclosure"). The first time you access any of your Consumer Account(s) at The National Bank & Trust Company through NB&T's e-banking, you agree to be responsible for any and all terms and conditions of this User Agreement and acknowledge your receipt and understanding of this and future disclosures.

     

DEFINITIONS

As used in this Agreement , the following words have the meanings given below:

"e-banking"refers to i-connect internet banking and mobile banking services provided to our customers.


"Account(s)" means your eligible NB&T checking, savings, loan, certificate of deposit or safe deposit box information and any other products that can be accessed through Mobile Banking.

"Device" means a supportable mobile device including a cellular phone or other mobile device that is web-enabled and allows secure SSL traffic which is also capable of receiving text messages.


"Mobile Banking" means the banking services accessible from the Device you have registered with us for Mobile Banking.


"You" and "Your(s)," mean each person with authorized access to your Account(s) who applies and uses the Mobile Banking service.


"We," "Us," and "Bank" means NB&T.

     

ACCEPTANCE OF AGREEMENT

You understand that by using NB&T's e-banking you have agreed to the terms and conditions of this User Agreement and that no signature by you is required on this User Agreement. You agree to use e-banking solely as outlined in this User Agreement and any and all applicable online instructions. When any transfer, payment or online service generates items to be charged to any of your NB&T Consumer Account(s), you agree that we may debit any of your accounts without requiring your signature on the item and without prior notice to you.

     

AUTHORIZATION

To access any and all Consumer Account(s) through i-connect and Mobile Banking , you must have an account with The National Bank & Trust Company and a valid i-connect Access ID and password.  You are responsible for keeping your Access ID and password secure. 

 

NB&T has implemented multi-factor authentication to provide added security.  However, users should take care to use antivirus software on personal devices and take additional precautions when using public terminals.  Users are responsible to implement security measures to protect their e-banking session, including use of complex and rotating passwords, unique security questions and one-time passwords. You are responsible for keeping your Access ID and Password secure.

You agree to take every precaution to ensure the safety, security and integrity of your account and transactions when using
e-banking
services. You agree not to leave your Device unattended while logged into e-banking services and to log off immediately at the completion of each access by you. You agree not to provide your Access ID, Password or other access information to any unauthorized person. If you permit other persons to use your Device, login information, or other means to access e-banking services, you are responsible for any transactions they authorize and we will not be liable for any damages resulting to you. You agree not to use any personally identifiable information when creating shortcuts to your Account.

You understand that by using i-connect and Mobile Banking, you represent that you are the legal owner of the Accounts and other financial information which may be accesse.  You represent and agree that all information you provide to us in connection with e-banking is accurate, current and complete, and that you have the right to provide such information to us. You agree not to misrepresent your identity or your account information and to keep your account information up to date and accurate. You represent that you are an authorized user of the Device you will use to access your account information.

We make no representation that any content or use of e-banking is available for use in locations outside of the United States. Access to e-banking from locations outside of the United States is at your own risk. 

Subject to the terms of this User Agreement, you will generally be able to access your Consumer Account(s) at the www.nabatco.com Internet site seven days a week, 24 hours a day. A transfer requested through i-connect before the transfer cutoff time (7:00 PM Central Time) on a business day will generally be posted to your Consumer Account(s) the same day. All transfers requested after the posted transfer cutoff time (7:00 PM Central Time) on a business day or on a day that is not a business day, will be posted on the next business day. Our business days are Monday through Friday. Saturdays, Sundays, and banking holidays are not included as business days.

At certain times, e-banking may not be available due to system maintenance or circumstances beyond our control. During these times, you may use our Touch Tone Banking service at (815) 895-9595 or (888) 895-9511, any of our NB&T automated teller machines (“ATM”) or any of our NB&T locations to obtain information about your Consumer Account(s).

     

ELECTRONIC MAIL

You can communicate with us via secure e-mails contained in internet banking. Please note that we may not immediately receive an electronic message sent by you. If you need to contact us immediately, please call NB&T's Client Support Center at (888) 895-2125. No action will be taken on any electronic message you send to us until we actually receive your message and have a reasonable opportunity to react to it. You cannot use electronic mail to make a bill payment, inquire about an account balance or transfer funds. You cannot use electronic mail to cancel a transfer, loan payment or bill payment.

     

CUSTOMER ACCOUNT STATEMENTS

Your daily transactions, payments and funds transfers will be posted on-line real-time and appear on i-connect and on your Consumer Account(s) statement(s). You can export your statement(s) into the following personal finance applications: Money® (.OFX), Quicken® (.QIF), QuickBooks® (.IIF), or Microsoft® Excel (or similar) software. You can access transaction information for your current and previous bank statement.  i-connect users are responsible for purchasing appropriate licenses for these systems.

     
MESSENGER - TERMS AND CONDITIONS

Free Messenger terms and conditions for use:

  • Use of the free Messenger service is at your own risk. The National Bank & Trust Company (NB&T) provides the messages from this free service to you on an "as is" basis. NB&T, it's affiliates and business partners or associates, make no warranties for this service of any kind, express or implied.
     
  • The sole function of this service is to provide our customers with timely notice of specific activity or events on their accounts per their request or instructions. Messenger cannot provide instant or immediate notification of account activity. Customers may incur interruptions, delays, errors or failure of receipt of their Messenger information for a variety of reasons, including technical difficulties with their ISP service provider, telecommunications provider or NB&T's computer system. In the event you choose to have your Messenger messages delivered to your cell phone or other similar devices, you understand and accept that a portion of the messages may be omitted or truncated. You also understand and accept that NB&T, their business affiliates, partners, or associates, make no warranties as to the timing, security, reliability or completeness of any of the messages provided or transmitted via Messenger.

  • Under no circumstances shall NB&T, their business affiliates, partners or associates be liable to you for incidental, consequential, special or punitive damages, including but not limited to loss of business, lost opportunities/profits, investment losses, finance charges, or other economic damages resulting in your use or reliance upon, in any way, the information contained in the free messages, whether the claim for damages is based on warranty, contract, tort, or any other legal theory, and whether or not NB&T is advised of the possibility of such damages.           
     

ELECTRONIC FUNDS TRANSFERS

e-banking enables you to transfer funds to or from your Consumer Account(s) at The National Bank & Trust Company. The Electronic Funds Transfer Act provides you with certain rights and responsibilities with respect to these transfers, called “Electronic Funds Transfers” (“EFT”)Your Rights and Responsibilities are fully described in our Electronic Fund Transfers disclosures that have been separately provided to you.

Your liability for an unauthorized EFT or a series of related unauthorized EFTs from your Consumer Account(s) at The National Bank & Trust Company will be determined as follows:
  1. If you notify us within two (2) business days after learning of the loss or theft of your Access ID or your password, your liability will not exceed the lesser of $50 or the amount of unauthorized EFTs that occur before notice to us.
  2. If you fail to notify us within two (2) business days after learning of the loss or theft of your password, your liability will not exceed the lesser of $500 or the sum of –
    • $50 or the amount of unauthorized EFTs that occur within the two (2) business days, whichever is less; and
    • the amount of unauthorized EFTs that occur after the close of two (2) business days and before notice to us, provided we establish that these EFTs could have been prevented had you notified us within that two-day period.
  3. You must report an unauthorized EFT that appears on a periodic statement within sixty (60) days of our transmittal of the statement to avoid liability for subsequent transfers. If you fail to do so, you may be liable for the amount of the unauthorized EFTs that occur after the close of the sixty (60) days and before you notify us, provided we establish that these transactions could have been prevented had you notified us within the 60-day period. You may, as applicable, also be liable for the amounts described in the immediately preceding sections 1 or 2 above.
  4. If your delay in notifying us was due to extenuating circumstances, we will extend the times specified in the immediately preceding paragraphs 1, 2 or 3 above to a reasonable period.
  5. You may initially notify us in person, by telephone or in writing, but we will require your written notification be received by the bank no later than ten (10) calendar days following the verbal notification.

If we do not transfer or otherwise issue a payment from your Consumer Account(s), requested by you in accordance with the terms and conditions of this User Agreement, Consumer Deposit Account Agreement and Disclosure and/or in accordance with i-connect bill pay instructions; or in the amount requested by you in accordance with the terms and conditions of this User Agreement and/or the i-connect bill-pay instructions, we will reimburse you for any late payment fees or penalties that you are charged in connection with such occurrence, up to a maximum of $50 for each such occurrence.

  • Through no fault of ours, you did not have enough money in your Consumer Account(s) to complete the transaction.
  • The money in your Consumer Account(s) was attached, subject to legal process, or was blocked in some other way.
  • The payment was made to a Non-business Payee.
  • You knew there was a technical malfunction in i-connect bill pay and you knowingly used it anyway.
  • You knowingly were trying to defraud us.
  • Circumstances beyond our control prevented the transaction from taking effect.

 

 

OUR LIABILITY

Except as specifically provided in this User Agreement or where the law requires a different standard, you agree that neither The National Bank & Trust Company nor any of the service providers we may use to support i-connect shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, The National Bank & Trust Company, Internet browser, access and/or service providers, or by any agent or subcontractor of any of the foregoing.

Neither shall The National Bank & Trust Company or any service providers be responsible for any direct, indirect, special or consequential, economic or other damages arising in any way out of the installation, use or maintenance of the equipment, software, the e-banking, or Internet browser or access software.
 

YOUR IDEMNIFICATION

Except to the extent of The National Bank & Trust Company’s liability pursuant to the terms of this User Agreement or any other agreement(s) or notice(s) that otherwise governs your Consumer Account(s), you agree to indemnify and hold us, our directors, officers, employees and agents harmless from any and all loss, liability, claims, demands, judgments and expenses (including attorney’s fees) arising out of, or in any way connected with, your use or misuse of NB&T's e-banking. This indemnification is provided without regard to whether our claim for indemnification is due to the use of e-banking by you, or your authorized representative.

 
OTHER GENERAL TERMS
Under prudent and proper business conditions, we may assign our rights and delegate our duties and responsibilities under this User Agreement to a company affiliated with us or to any independent contractors or other third parties.
 

OTHER AGREEMENTS

You are solely responsible for having the required hardware, software and for securing access devices and service providers. You agree that with the use of e-banking, you remain subject to the terms and conditions of your existing agreements with any unaffiliated service providers, including, but not limited to, your mobile service and internet provider and that this Agreement does not amend or supersede any of those agreements. You understand that those agreements may provide for fees, limitations and restrictions which might impact your ebanking usage (such as data usage or text messaging charges imposed on you by your mobile service provider for your use of or interaction with Mobile Banking), and you agree to be solely responsible for all such fees, limitations and restrictions. You agree that only your mobile or internet service provider is responsible for its products and services. Accordingly, you agree to resolve any problems with your provider(s) directly without involving us.  

 

In addition to this e-banking user agreement, you agree to be bound by and will comply with the requirements of all applicable Consumer Deposit Account Agreement and Disclosure, the Bank’s rules and regulations, applicable Wire Transfer or ACH Agreements, the rules and regulations of any funds transfer system to which the Bank belongs, and applicable State and Federal laws and regulations.

 

AUTHORIZATION TO OBTAIN INFORMATION

You agree that we may obtain and review your credit report from a credit bureau. You also agree that we may obtain information regarding your Payee accounts in order to facilitate proper handling and crediting of your payments.

 

CHANGES TO CHARGES, FEES, OR OTHER TERMS

We reserve the right to change the charges, fees or other terms described in this User Agreement. However, when changes are made to any fees or charges, we will notify you online, or send a notice to you at the address shown on our records, or send you an electronic mail message (E-mail). The notice will be posted or sent at least thirty (30) days in advance of the effective date of any additional fees for Internet Banking transactions, or of any stricter limits on the type, amount or frequency of transactions or any increase in your responsibility for unauthorized transactions, unless an immediate change is necessary to maintain the security of the system. If such a change is made, and it can be disclosed without jeopardizing the security of the system, we will provide you with electronic or written notice within thirty (30) days after the change. As always, you may choose to accept or decline changes by continuing or discontinuing the accounts or services to which these changes relate. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees in individual situations. Changes to fees applicable to specific accounts are governed by the applicable Consumer Deposit Account Agreement and Disclosure.

 

ACCOUNT INFORMATION DISCLOSURE

The circumstances under which we will disclose information about you or your Consumer Account(s), has been separately disclosed to you in our Privacy Policy and in other disclosures which have been provided directly to you. Our Privacy Policy may change from time to time and is always available online and at our banking locations.

 

FEES

There are no monthly or transaction fees for using e-banking The Consumer Deposit Account Fee Schedule applies to your Consumer Account(s). Other fees may be assessed and billed separately by your online service provider.
